Privacy Policy

Purpose of statement

The purpose of this document is to provide appropriate information and protection for the processing and protection of personal data of natural persons who come into contact with Meister Car Hungary Kft. in accordance with the provisions of Act CXII of 2011 on the Right to Information Self-Determination and Freedom of Information and REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL.

The purpose of this statement is to set out the data protection and data management principles and the data protection and data management policy of Meister Car Hungary Kft., in order to ensure that in all areas of the services provided by the contractor, all individuals are guaranteed that their rights are respected when their personal data are processed.

Meister Car Hungary Kft. reserves the right to update this privacy policy at any time due to changes in legislation or other changes. Changes will take effect upon uploading the revised Privacy Policy.

Definitions

data subject: any specified natural person who is identified or can be identified, directly or indirectly, on the basis of personal data

personal data: data which can be associated with the data subject, in particular the name, the identification mark and one or more factors specific to the physical, physiological, mental, economic, cultural or social identity of the data subject, and the conclusions which can be drawn from the data concerning the data subject.

consent: a voluntary and explicit indication of the data subject's wishes, based on adequate information, by which they give their unambiguous agreement to the processing of personal data relating tothem, either in full or in relation to specific operations.

objection: a statement by the data subject objecting to the processing of their personal data and requesting the cessation of the processing or the erasure of the processed data.

data controller: the natural or legal person or unincorporated body which, alone or jointly with others, determines the purposes for which the data are processed, makes and executes decisions regarding the processing (including the means used) or has the processing carried out with the processor.

data management: any operation or set of operations which is performed upon data, regardless of the procedure used, in particular collection, recording, recording, organisation, storage, alteration, use, consultation, disclosure, transmission, alignment or combination, blocking, erasure and destruction. In addition, the prevention of further use of the data, the taking of photographs, audio or video recordings and the recording of physical characteristics that can be used to identify a person (e.g. fingerprints, palm prints, DNA samples, iris scans).

data erasure: rendering data unrecognisable in such a way that it is no longer possible to recover it.

data destruction: the total physical destruction of a data medium containing data;

data processing: the performance of technical tasks related to data processing operations, irrespective of the method and means used to perform the operations and the place of application, provided that the technical task is performed on the data;

data processor: a natural or legal person or an unincorporated body which processes data on the basis of a contract, including a contract concluded pursuant to a legal provision.

data breach: a breach of security resulting in the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data transmitted, stored or otherwise processed

Meister Car Hungary Kft. is committed to the protection of the personal data of its customers and partners, and attaches great importance to respecting the right of informational self-determination of its customers, therefore it handles personal data confidentially and takes all security, technical and organizational measures to guarantee the security of the data.

Purpose of data processing

The Data Controller processes the data provided solely for the purposes of determining, modifying, fulfilling, invoicing and enforcing claims or contacting the Data Subjects in relation to the content of the service requested.

Please be informed that the processing for the above purposes is also carried out only in the manner specified in the applicable legislation, to the extent and for the time necessary to achieve the purpose and only with the personal data that is indispensable for the achievement of the above purposes and is suitable for the purpose.

Legal basis for data processing

The data processing of Meister Car Hungary Kft. is based on voluntary consent, contractual or legal obligations.

Scope of personal data processed

In case of request for quotation: name / company name, telephone number, address, e-mail address.
In case of contracting: in addition to the above, place and date of birth, name of the mother of the customer.

Commercial enquiries

Meister Car Hungary Kft. will inform the subscribers of its newsletter about its news and special offers by means of commercial enquiries. Meister Car Hungary Kft. may contact the subscribers by e-mail at the e-mail address provided by the customer on its website. The marketing activities of Meister Car Hungary Kft. are carried out by the customer with his/her prior, explicit and informed consent, given by ticking the checkboxes of the consent box, which is not ticked by default.

The customer can unsubscribe from the newsletter service at any time via the unsubscribe link in the newsletter.

Duration of processing

The Data Controller shall process personal data until the customer relationship is established in the case of a request for a quotation, in the case of a contract until the deadline for the performance, settlement and payment of the service ordered by the Data Subject and the deadline for the submission of the related warranty claim, the closure of the submitted claim, and the enforcement of other civil law claims. Data processing does not apply to data processing required by law (e.g. accounting regulations [Act CL of 2017 on the Rules of Taxation, Section 78 (3)]), which the Data Controller shall retain for the period specified by law.

Placement of cookies

Meister Car Hungary Kft. places a small data package, so-called cookie, on the customer's computer in order to facilitate the personalized service and the operation of the website. Detailed information about cookies can be found at the bottom of our website.

Who can access the data, data transfers

The managing director of Meister Car Hungary Kft. and the employees of the company whose job description includes the data processing activity, subject to the signing of a confidentiality agreement.

The Data Subject is aware that if the transfer of his/her personal data by the controller is necessary for the performance of a contractual obligation, e.g. to an energy supplier, he/she will provide for the transfer in a separate declaration.

The Data Controller shall not be liable for the accuracy of the personal data provided by the Data Subject and the Data Subject shall be solely responsible for the accuracy of such data.

Rights of the data subject

The data subject may at any time request information about the data processed by the Data Controller, including the scope of the data processed, the time and method of data recording, as well as the principles and rules in force regarding data processing.

The data subject shall have the right to obtain, upon his or her request and without undue delay, the rectification by the controller of inaccurate personal data relating to him or her. Having regard to the purposes of the processing, the data subject shall have the right to obtain the rectification of incomplete personal data, including by means of a supplementary declaration.

The data subject may request the controller to erase personal data relating to him or her without undue delay and the controller shall, unless the processing is based on a legal obligation, erase personal data relating to the data subject without undue delay.

In the case of a person acting on behalf of another person, it is his or her responsibility to obtain the consent of the Data Subject to disclose his or her data. The prior consent of the legal representative is required for the declaration of incapacitated persons and persons with reduced capacity to act.

At the request of the data subject, the controller shall provide information about the data of the data subject processed by the controller or by a processor to whom the controller or the processor has delegated the processing, the source of the data, the purpose, legal basis and duration of the processing, the name and address of the processor and the activities of the processor in relation to the processing, the circumstances of the personal data breach, its effects and the measures taken to remedy it, and, in the case of transfer of the data subject's personal data, the legal basis and the recipient of the transfer.

The Data Controller shall provide the information in writing within the shortest possible time from the date of the request, but not later than 25 days from the date of the request, upon request of the Data Subject. Provide a reasoned reply in the event of refusal of the Data Subject's request. If the Data Subject does not agree with the decision or action taken by the Data Controller, he or she may appeal against the decision or action - within 30 days of its notification - to the National Authority for Data Protection and Freedom of Information (1125 Budapest, Szilágyi Erzsébet fasor 22/C.) or to a court.

Objection to the processing of personal data

The data subject may object to the processing of his or her personal data on the basis of the Info.

a) the processing or transfer of the personal data is necessary solely for compliance with a legal obligation to which the Data Controller is subject or for the purposes of the legitimate interests pursued by the Data Controller, the data importer or a third party, unless the processing is required by law;
b) the personal data are used or transmitted for direct marketing, public opinion polling or scientific research purposes;
c) in other cases specified by law.

The Data Controller shall examine the objection within the shortest possible time from the date of the request, but not later than 15 days, decide whether the objection is justified and inform the applicant in writing of its decision. If the Data Controller finds that the data subject's objection is justified, the Data Controller shall terminate the processing, including further recording and transmission, and block the data, and notify the objection and the action taken on the basis of the objection to all those to whom the personal data concerned by the objection have been previously disclosed and who are obliged to take measures to enforce the right to object. Where the data subject disagrees with the decision taken by the controller and where the controller fails to comply with the time limit, the data subject may, within 30 days of the notification, take the matter to court. The data subject may also take legal action in the event of a breach of his or her rights. The court shall rule on the matter out of turn.

The tribunal shall have jurisdiction to hear the case. The action may also be brought, at the option of the person concerned, before the court of the place where he or she resides or is domiciled.

Meister Car Hungary Kft. takes appropriate measures to protect the data, in particular against unauthorized access, alteration, transmission, disclosure, deletion or destruction, as well as against accidental destruction, damage and loss of access due to changes in the technology used.

If the Data Subject has provided data of a third party for the use of the service in the course of the communication and has caused damage in any way, the Data Controller shall be entitled to claim damages from the Data Subject. In such a case, the Data Controller shall provide all reasonable assistance to the competent authorities in order to establish the identity of the offending person.

Remedies

The Data Subject may take the Data Controller to court in the event of a breach of his or her rights.

Other provisions

Our company does not control the personal data provided to it. The person providing the data is solely responsible for the correctness of the data. By providing an e-mail address, any data subject is also responsible for ensuring that he or she is the only person using the e-mail address provided.

We inform our customers that the investigating authority, the National Authority for Data Protection and Freedom of Information, or other bodies authorized by law may contact Meister Car Hungary Kft. for information, disclosure, transfer of data or provision of documents.

The Data Controller shall ensure the security of the data, and shall take technical measures to ensure that the data recorded, stored or processed are protected, and shall take all necessary measures to prevent their destruction, unauthorised use or unauthorised alteration. It also undertakes to require any third party to whom it may transfer or disclose the data to fulfil its obligations in this respect.

When processing the data, the Data Controller shall act with the utmost care and in full compliance with the law, shall treat them confidentially and shall not disclose them to third parties, unless this is necessary to enforce its rights and obligations arising from the contract or unless the disclosure of the data to public authorities is required by law or by a final decision of a public authority or court.
